Authorizing Approval of an IDOT - County Joint Agreement for Improvements on Manhattan-Arsenal Road (CH 17) from Baseline Road to Magnolia Lane, County Board District #6

WHEREAS, the State and the County, in order to facilitate the free flow of traffic and insure safety to the motoring public, are desirous of making improvements to Manhattan-Arsenal Road (CH 17) from Baseline Road to Magnolia Lane; Project No. EMQ3 (384), Job No. C-91-044-10, County Section 00-00117-13-FP, County Board District #6, (the “Project”); and

WHEREAS, the County is desirous of said improvement in that the same will be of immediate benefit to the county residents and permanent in nature.

WHEREAS, the Federal Highway Administration, (FHWA) has committed $1,409,918 in HPP funds to help finance the Project.

NOW, THEREFORE, BE IT RESOLVED, that as set forth in the agreement, the Will County Board authorizes the expenditure of $7,206,330.00 for the construction and construction engineering costs of the Project to be allocated from the County's allotment of County RTA Tax funds or County Highway Tax Funds or County Matching Tax Funds, with $1,409,918 to be reimbursed by the State, to the County, from FHWA HPP funds

BE IT FURTHER RESOLVED, that the Will County Board authorizes the Will County Executive to enter into an agreement with the Illinois Department of Transportation for the improvement of Manhattan-Arsenal Road (CH 17) from Baseline Road to Magnolia Lane in substantially the same form as attached hereto and made part hereof, (the “Agreement”).

BE IT FURTHER RESOLVED, that the County Executive and the County Clerk of Will County are hereby authorized and directed to execute said agreement, subject to the review and approval by the Will County State's Attorney.

BE IT FURTHER RESOLVED, that the clerk is hereby directed to transmit five (5) certified copies of this resolution and the agreement to the regional office of the Illinois Department of Transportation through the office of the Director of Transportation/County Engineer.

BE IT FURTHER RESOLVED, that the County Executive and the County Clerk of Will County are hereby authorized to enter into any amendment of the Agreement that provides for additional State funding for the Project, so long as it does not require substantial modification of the Project or additional funding from the County, subject to the review and approval by the Will County State’s Attorney.
