WHEREAS, the Planning and Zoning Commission of Will County, Illinois has recommended the reclassification of a certain area within the County as hereinafter described; and

 

WHEREAS, such recommendation was based upon a duly publicized hearing by said Planning and Zoning Commission of Will County affecting property located in Green Garden Township where such area is situated; and

 

WHEREAS, due notice of the time and place of such hearing was published in a paper of general circulation in Will County, Illinois; and that report thereof has been made to this Board within thirty days after such hearing.

 

NOW, THEREFORE, BE IT ORDAINED, by the County Board of Will County, Illinois:

 

Section 1.  That the “Will County Zoning Ordinance”, approved September 9, 1947, as amended, is and the same is hereby amended by reclassifying the area described as follows:

 

Map Amendment from A-1 to E-1 for Parcel 2

 

Legal Description: 5.705 Acre Parcel

Section 2.  That the County Clerk shall alter the map of said territory described in Subsection 3.1, Section 3 of said Will County Zoning Ordinance to indicate such revised classification and shall certify such alteration by her signature and the date thereof, file the same and make available for public reference.

 

Section 3.  This Ordinance shall be in full force and effect upon its passage and approval as provided by law (or passage, approval and publication as provided by law).

Marguerite Kenny presented Zoning Case # ZC-18-086, which takes place in Green Garden Township. The owner is Michael Stajszczak and the agent representing the owner is Joseph Adcock.

The applicant is requesting a map amendment from A-1 to E-1 for parcel 2. The applicant is wishing to divide the existing 16.26 acre parcel into 2 conforming parcels. The first one would be 10.56 acres and remain A-1, while parcel 2 would be only 5.7 acres and is the subject of tonight's map amendment request.

The parcel is located along South 80th Avenue and West Dralle Road in Frankfort.

According to the County's Land Resource Management Plan, this parcel lies within the rural areas formed.

The parcel also has a pole barn to the south that will be contained on parcel 1.

In order for parcel 1 to remain A-1, it will need to meet the 300 foot lot frontage requirement that the A-1 District has. This is why there is about 40 feet along Dralle Road, just to make sure they meet that minimum requirement.

It is Staff's professional opinion, that residential uses are more appropriate to this parcel, opposed to agricultural.

The subject property is currently zoned A-1. It was previously split-zoned between A-1 and A-2, where A-2 was the frontage along Dralle Road. A Split-Zoning decision was administratively approved previously that applied A-1 to the entire parcel. That took place in 2017.

To the north there is A-2 agricultural residential, as well as E-2, Estate residential, which is a platted subdivision. To the south is A-1 agricultural as well as an E-2 residential. To the east is A-2 agricultural residential. To the west is R-2 single family residential. The area has seen many different residential changes during the past 30 years. Development has been sporadic, there has not been a real trend occurring in this area. The last map amendment in the area occurred in about 2010. It was A-1 to E-1 and was roughly 1/2 mile north of the subject parcel.

The Village of Frankfort was notified of this map amendment request, and provided no comments or objections.

The parcel also conforms with the Green Garden Township 2017 Comprehensive Plan. It does lie within mixed residential agricultural uses. Within the Township's Comprehensive Plan, they accept straight estate zoning on parcels not able to connect to water or sewer.

Green Garden Township Board was notified of the proposed map amendment request, and on January 14, 2018, voted to approve map amendment request.

Upon approval of this request tonight, both parcels will meet the minimum standards for their perspective districts.

Staff notified the agencies within a mile and a half, the Fire Protection District and the road authority. None of which had any objections. We did get Health Department comments, but again, no objections.

Staff is recommending approval of the map amendment from A-1 to E-1 for parcel 2. It is Staff's professional opinion that the E-1 is suitable for the area.

Chairman Stipan invited the owner/agent to come forward.

Joseph Adcock, Agent, wanted to thank the Staff. He said they were great for helping him get this put together.

This parcel is on the corner of Dralle Road and 88th Avenue.

The applicant wishes to divide the 16.26 acre parcel into 2 conforming parcels. Parcel 1 would be 10.56 acres and remain A-1, while parcel 2 would be 5.7 acres. Parcel 2 is the subject of the map amendment request. As a reminder, A-1 typically has a lot area of 10 acres with 300 feet of lot frontage. Parcel 1 would meet the lot standards for the A-1 district, but parcel 2 would not. Therefore, they are requesting the E-1 zoning district, because E-1 requires 215,000 square feet or 4.9 acres for lot area, as well as minimum lot frontage of 300 feet. Parcel 2 would meet the E-1 standards.

The Planning and Zoning Commission voted to approve the map amendment request 6-0, and there were no objectors.

Amanda Koch asked if A-1, does that go with the character of the A-1 that is around it?

Marguerite Kenny stated that it did.

Amanda Koch said I know we don't want to mix.

Marguerite Kenny stated that the area does see a lot of E-1. There is E-2 across the street.

Amanda Koch said so it does fit the character?

Marguerite Kenny said it does fit.
